Long <br /> Division Director <br />Re: Scheduled Inspection, Shangri La Pit, M-1989-024 <br />Deaz Mr. Yaklich: <br />The Division is prepazing to take you to the Mined Land Reclamation Board (Boazd) for failure <br />to maintain a financial warranty in good standing because your bonding company went into <br />liquidation last yeaz. <br />I will need to look at the site to see if you have initiated mining activities. If you have, you will <br />need to appear before the Boazd at the Tune 26-27, 2002 meeting to explain why you have not <br />maintained a financial warranty in good standing. If the Boazd finds a violation, they may assess <br />a civil penalty in the amount of $100.00 - $1,000.00 per day for each day of violation. <br />If you have not initiated mining activities at the site, there aze a few options. You may request a <br />release of financial warranty, which would terminate the permit, or you can submit another <br />financial warranty in the amount of $5,000.00. Cash bonds, CD's or Corporate Sureties are <br />acceptable financial warranties. If you do not address this problem, the Division may ask the <br />Board to revoke the permit. You can contact Ms. Bazbaza Chiappone for more information <br />regarding bonding documents at 303-866-4074. <br />I should be at the site between 1:00 p.m. and 2:00 p.m. on May 30, 2002; weather permitting. <br />I am sending a copy of this letter to the two (2) addresses we currently have.
