(Operator) and with the authority to act on behalf of the Operator hereby requests the <br />following: <br />Colorado Marble, Inc. wishes to waive our rights to a 30 day notice for the hearing to <br />consider withdrawal of the Possible Notice of Violation Hearing for failure to follow the mining and <br />reclamation plan. This is the hearing that has been continued since the December 15, 2004 <br />Board Meeting. <br />It is my hope that by waiving our rights we expedite the permitting process now before <br />the Board. Our plan is to continue working to rectifying the remaining issues now before the <br />Board as expeditiously as possible and come into and remain in compliance with all the mining <br />laws and regulations for the State of Colorado. <br />Carl I sincerely appreciate all your assistance in this regard and look forward to working <br />with you as we continue to proceed Towards full compliance. <br />Respec' ly, '~ <br />olloway <br />
