Summary <br />The Review Process <br />Mining at the King I Mine began azound 1941 and was operated for many yeazs by V iola Smith. The <br />site was permitted by National King Coal Inc. in 1982 and the permit has been renewed every five <br />years since then. National King Coal Inc. reincorporated as National King Coal LLC (NKC), in <br />June, 1995. Permit C-81-035 was most recently renewed on December 16, 2002. Unti12006 the <br />permit area was confined to lands south of La Plata County Road 120, the King I Mine. In 2006 PR- <br />8 was approved, adding 720 acres north of the road, the King II Mine. Each mine has its own <br />underground workings and surface facilities. <br />The Division received the application for RN-OS on February 16, 2007 and found it complete on that <br />day. The complete application was filed at least 180 days prior to permit expiration, thereby securing <br />the right of successive renewal provided by 2.08.5. The Division sent completeness notices in <br />accordance with Rule 2.07.3(3)(b). The Division received comments from the State Historic <br />Preservation Officer and the Office of the State Engineer (as discussed below). No other comments <br />were received. <br />The Division received a memorandum from the Office of the State Engineer on March 12, 2007 and <br />forwarded it to NKC on that day. The memorandum stated that water supply wells used by the mine <br />must be permitted and either covered by an augmentation plan or a demonstration that water isnon- <br />tributary. The Division requested in a technical adequacy letter dated July 27, 2007 that NKC <br />provide documentation of resolution of the issues noted in the memorandum from the Office of the <br />State Engineer. NKC responded in a memorandum dated August 15, 2007 that an augmentation plan <br />and transfer of water well rights are in prepazation. The Division attached Stipulation 17 the mining <br />and reclamation permit in order to document that upon approval of the augmentation plan and <br />transfer of water well rights, NKC will need to add these items to the list of other licenses and <br />permits in the permit application that is required by Rule 2.03.10. <br />The Division received a letter from the State Historic Preservation Officer on Mazch 26, 2007 stating <br />that RN-OS would not impact cultural resources. <br />NKC resolved all of the Division's adequacy comments by submitting responses in an email <br />memorandum and phone call on August 15, 2007 (phone call documented by DRMS email of <br />August 17, 2007), and by submitting an application for Technical Revision TR-13 which includes an <br />updated Mine Plan Map for the King I Mine. <br />Description of the Environment <br />The King I and II Mines are located approximately seven miles southwest of Hesperus, Colorado <br />along La Plata County Road 120 in Hay Gulch. The site can be located on the Hay Gulch and Loma <br />Linda 7.5 minute USGS quadrangle maps. <br />4 <br />
