Surface Coal Mining and Reclamation Act regulations still
require all highwalls to be eliminated. ~~~lcJ,l~()
12) The Division initiated rule making changes to rule 4.14 in
August 1992 to account for pre-existing highwalls prior to the
enactment of CSCMRA.
13) The Division, and the operator would like to amend the March
25, 1992 Settlement Agreement with an extension of time for
issuance of an approved reclamation only permit to the
operator pending rule making proceedings.
14) Once again we feel that we are faced with two options, either
issue the permit and have the OSM issue a Federal Violation
for the remaining highwall or extend the time until issuance
of the permit to allow for final rule change.
15) OS lbuquerque Field office has indicated that they won't
0 7ect to this course of action.
