Hagen: <br />We received the above referenced Ten Day Notice on April 5, 1991. <br />Roy Ramer, <br />Govamor <br />Freo R. Banta, <br />Division Director <br />The Division and OSMRE, AFO have communicated on numerous occasions regarding <br />the propriety of our bond adjustment process. The correspondence indicates <br />the we continue to disagree over these adjustments. In an effort to resolve <br />this concern, I have recently suggested to you that a Rule change would <br />satisfy your concerns. We are scheduled to discuss this matter further at our <br />first quarterly meeting on April 10, 1991. <br />Given the natire and substance of our correspondence and the likelihood of <br />rule making, I do not believe that a Ten Day Notice is the proper forum for <br />resolution of this issue. The Division's bond adjustment practices are <br />clearly a programmatic issue and must be resolved as such. <br />The Division believes that the permittee is in compliance with the <br />December 7, 1990 revision approval. This is substantiated by the record in <br />that matter. Therefore, we will not issue a Notice of Violation in this <br />matter. <br />I am looking forward to resolving this issue through the appropriate <br />programmatic process with you. <br />Please contact me, if you have questions or comments. <br />Sincerely, i _. <br />Steven G.
