probably a contributing factor. Any movement of the pipe, by whatever means, would probably <br />cause leakage at the rusted locations on the pipe. It is Ms. Tatum's position that the water pipe <br />leaks and subsequent pasture damage occurred due to subsidence impacts associated with the <br />adjacent Basin Resources mine. <br />During the inspection, Ms. Tatum and David Berry also viewed and documented damage to the <br />Tatum residence and garage. It is Ms. Tatum's position that new damage has occurred, in <br />addition to the damages previously addressed with the above-referenced court and IBLA <br />proceedings, and that the new damage to the Tatum residence and garage is a result of ongoing <br />subsidence impacts from the adjacent Basin Resources Mine. Exterior western by back door. <br />As a result of this inspection, the DMG issues the attached Notice of Violation No. CV-2000-009 <br />to Basin Resources, Inc. The Notice of Violation is issued because it appears that subsidence <br />impacts, originating at the adjacent Golden Eagle Mine, operated by Basin Resources, are <br />adversely impacting the Tatum residence, garage, water line and pasture. The permit document <br />for this mine (Permit No. C-81-013) specifies that no such damage would occur. The previously <br />referenced IBIS, ruling of July 26, 2000 found that the Basin Resources, Inc., Golden Eagle <br />Mine did previously cause subsidence damage to the Tatum residence. The damages observed <br />during the October 25, 2000 inspection are consistent with the damages previously attributed to <br />subsidence impacts from the mine, as documented in the IBLA ruling. Because the damages <br />observed during the October 25, 2000 inspection are consistent with the previously documented <br />subsidence related damages, and based upon the statements of Ms. Tatum that the damages <br />observed during this inspection occurred since the damages previously addressed by the IBLA, <br />the DMG is issuing the attached Notice of Violation. <br />
