<br />M M <br />_2_ <br />• CEASE AND DESIST ORDER <br />Based upon these same Findings of fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(21,(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Hard Rock Pa vi no 8 Redi-Mix to: <br />1. Cease and desist from conducting the following mining operations at the <br />Hart Rok Main Gravel Pit, Permit M-77-197. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Complete the foilowina corrective action: <br />Submit the E50.00 Annual Fee, Notice of Intent to Continue Mining (Annual <br />Report), and Map for 1990 for Permit No. M-77-197 to the Mined Land <br />Reclamation pivision by no later than June 1, 1990. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the <br />amount of E50.00, within 30 days of the signature date of this document. <br />• This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions reouirinp certain acts <br />to be performed within a certain time, shall be construed as a Dermit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />Dated at Denver this 30th day of April, 1990. <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />rKtu aauia, uir tar <br />Mine Land Reclamation Division <br />FRBlbdc <br />7029G <br />
