Minutes, August 23-24, 1989 <br />PAGE 3 <br />It was MOVED that the Board find the operator in violation for failure <br />to reclaim ands affected by mining operations, direct the operator to <br />continue reclamation and that a Civil Penalty be assess in the amount <br />of E200 per day for 60 days of disturbance or E12,000. SECONDED AND <br />PASSED UNANIMOUSLY (Danielson, O'Connor, Entz, Kraeger-Rovey and <br />Cooley) . <br />6. FORMAL PUBLIC HEARING <br />N File No. M-87-072 <br />1683 Clarkson <br />Denver, CO 80210 <br />All persons wishing to give testimony were sworn. <br />Sec. 20, T3S, R72W, Gilpin County, 2.5 acres. 110 gold placer. <br />Consideration of possible notice of violation, cease and desist order, <br />corrective actions and civil penalties for mining without a permit. <br />Staff related that the Division had been notified by BLM that there was <br />possible mining without an approved permit at the site. Staff <br />referenced the Division's file, regarding Mr. Conner, and briefly <br />presented a history of this matter. This application was approved on <br />May 27, 1987, with the contingency that the approval would be <br />contingent upon final local government approval. At that time, a <br />E1 ,000 bond and a performance warranted were requested. In June, 1987 <br />the Division received a letter from the Gilpin County Office stating <br />that Mr. Conner did receive county approval. No further material or <br />information was available from that file. There is no financial <br />warranty nor performance warranty intact at this time, therefore, no <br />permit has been issued. <br />The site was inspected on July 21, 1989. Staff showed slides from that <br />inspection, and they were discussed. Staff presented ATTACHMENT B - a <br />Civil Penalties/violations Worksheet. <br />Mr. Stanley Conner related that he had been conducting assessment and <br />prospecting work at the site, while waiting for information regarding <br />the acceptability of a performance bond. He showed pictures of the <br />site that were taken approximately two years before his operation was <br />begun and answered questions from the Board. <br />Mr. Jim Perry, with the Bureau of Land Management, provided the Board <br />with information that one of BLM's Range Conservationist discovered <br />that Mr. Conner was placer mining in 1986. He showed snapshots from an <br />inspection that he conducted in September of 1986. At that time, Mr. <br />Conner was informed that he needed to notify BLM and MLR of his <br />activities. Mr. Perry answered questions from the Board. <br />Mr. Lee Jessie Peterson answered the Board questions, regarding old <br />tailings at the site and discussed discovery areas. <br />
