Minutes, August 23-24, 1989 <br />PAGE 20 <br />M11r. Thompson referenced the map included in the permit application to <br />address the issue of the permit boundary, and answered questions from <br />the Board. <br />Staff suggested that if the operator paid the E3 ,400 outstanding Civil <br />Penalty, the Division could work with the operator to resolve the <br />misunderstanding and, at the September Board ~+leeting, present a packet <br />of those resolutions to the Board. <br />On behalf of the operator, Mr. Merritts asked the Board to allow them <br />to meet with the Division to find out what additional information, <br />studies, etc., would be required to satisfy the corrective action; he <br />also asked at that time that they be allowed to negotiate terms for the <br />payment of the Civil Penalty. <br />It was MOVED that the Board schedule this Item for the September Board <br />Meeting~fior consideration of permit revocation and bond forfeiture and, <br />in the meantime, direct the operator and Staff to meet in an attempt to <br />work out the necessary corrective action, in order to comply with the <br />Cease and Desist Order; direct the operator to pay the full E3 ,400 <br />Civil Penalty and, at the September Board Meeting, if the Penalty had <br />been paid and the corrective action had been agreed to and initiated to <br />the Board's satisfaction, this would be taken into consideration, <br />regarding whether or not to, at that time, proceed with the permit <br />revocation and bond forfeiture proceedings.
