NWO-2006-3U3-1)EN <br />llear Ms- Wcisenbache <br />Reference is made to your T)eccmber 1, 2006 fax letter to Mr. 'ferry McKee of my office concerning the <br />above-rcferx:nced project located in the NE 114 of Section 3, Township 7 North, Kange G9 West, Larimer County, <br />Colorado. <br />Based on the information provided, this office has determined that the work within Colorado is <br />authorized by the Department of the Army Natioawide Permit No. 1.4, found in the March y, 2000, Federal <br />Register, Final Notice of Issuance, Reissuanee, and Modification of Nationwide Permits (65 PR }2818). <br />f nelosed is a fact sheet which fully describes this Nationwide Pcrnut and lists the Genera} Conditions, Section <br />404 Only Conditions, and Colorado Regional Conditions which must be adhered to for fliis authorization to <br />remain valid. <br />In order for this nationwide perudt verification to be valid the road crossing shall be designed to <br />pass and withstand normal high tlevvs. <br />Although an Individual Deparhr)ent of the gmty pemul will not be required for Otis project, this does not <br />eliminate the requirement that any other applicable Federal, state, tribal or local permits be obtained .u required. <br />Please be advised that deviations from the original plans and specifications of this project couldrequirc <br />additional authorization fiom this office. <br />The applicant is responsible for all work accomplished in accordance with Phe terms and conditions of <br />the nationwide permit. !f a contractor or othe.7 authorized representative will. be accomplishing the work <br />authorized by the nationwide permit al behalf of the applicant, it is shongly recommended that they be provided <br />a copy ot'this letter and fife attached conditions so that they arc aware of the limitations of the applicable <br />nationwide permit. Any activity which fails Co comply with all the terms and conditions of the nationwide permit <br />will be considered unauthorised and subject to appropriate enforcement action. <br />'t'his verification is valid until the nationwide permit is modified, reissued or revoked. The <br />nationwide permit is scheduled to be mod}fled, reissued or revoked prior to March 1R, 2007. it is <br />incumbent upon you to remain informed of changers to the nationwide permit.
