Although we can appreciate your concern of <br />citizens being adversely affected by fugitive dust from the Empire Pit's stockpile area, the Mineral Rules and <br />Regulations of the Colorado Mined Land Reclamation Boazd for the Extraction of Construction Materials do not <br />have provisions for control of fugitive dust from permitted mine sites. We understand that the operator, City of <br />Golden, is well aware of the fugitive dust concern and will take appropriate measures, as needed, to minimize <br />future dust emissions. As you may know, the Division approved the City of Golden's amendment applicarion <br />on September 9, 2004.
