The
proposed liability release area, as delineated on Map 1, does not include any alluvial valley floors,
croplands, or prime farmlands. Table 1, Eagle No. 5 Mine -Liability Release Areas, provides a legal
description of the subject lands.
. Conversations with individuak familiar
with the 5 Mine operations indicaze thaz the combination of geologic conditions and a massive
competent overlying sandstone unit resuhed in very good roof condiions doting muting, linuting
requirements for roof bohing and other growrd control measwes. Given thaz the western por[ion of
the 5 Mine was developed and operated during the eazly 1970's through the eazlg to mid-1980's,
current subsidence evaluation and monitoring requiremetts were not yt:t in place. Consequently, little
or no subsidence documentation is available for this area Based, however, on both historic
descriptions and recent visual inspections, little or no visible surface subsidence has occured over the
5 Mine western worlflngs.
Normally, surface subsidence associated with underground coal mines occurs within 3 months to 3
years of undernuning, with little or no subsidence occurring after 5 years. In this case, little or no
surface subsidence has been observed over the 5 Mine western worlflngs; no minurg has occurred in
this area in approximately 19 years, and it is approximately 14 years beyond the normal nraxituum
period for subsidence to occur.
BTUE »pire Crnporatim * 29515 RCR 27 CLk Cia~z, 0080467 * (970f 870-2712
c~,adc..ye,~mt:,~,- .
8/IdMpm
Reuses- Qrdxr 2004
