i <br />• • III IIIIIIIIIIIII III <br />999 <br />RECEIVEQ TOZER PIT <br />~ l~',~3 Amendment Application (AM-01) <br />~~~ 1 `' Permit No. M-78-107 <br />Division of Minerals ~ -• ~ - <br />~, +; ~~ ~~ E:..+,~ COPY <br />Sfi.E:: 'ro2en Pit <br />Purpose of the Pre-Hearing Conference is to identify the parties for the Formal Public Hearing, and to <br />identify the issues to be considered by the Colorado Mined Land Reclamation Board at the hearing, <br />and to draft the Pre-Hearing Conference Order. <br />HEARING: November 18-19, 1998, 9:00 a.m., at 1313 Sherman Street, Room 318, Denver, CO. <br />PARTIES: Prior to the Pre-Hearing Conference, parties to the Tozer Pit application are as follows: <br />Montezuma County (Applicant) <br />Southwest Land Services (Agent for Applicant) <br />Division of Minerals & Geology (Permitting Agency) <br />Eric Lindgren (Objector) <br />INTERESTED AGENCY: BLM, San Juan Resource Area (Public Lands Administrator) <br />OBJECTION: Prior to the Pre-Hearing Conference, DMG received a written objection to the <br />application from Eric Lindgren. Mr. Lindgren's objection issues are as follows: <br />1. lnsufficient notice Time to allow public comment; <br />2. lnsufficient description of the operation provided with the notice; <br />3. Scale of proposed operation; <br />4. Noise pollution; <br />5. Air pollution; <br />6. Truck traffic; <br />7. Times of operation; and <br />8. Operation may become an unacceptable nuisance. <br />9. Compliance with EPA regulations regarding particulate emissions. <br />SUPPORT: Prior to the Pre-Hearing Conference, DMG received a written statement, supporting the <br />issuance of the application, from Brian Kimmel of Southwest Land Services. Mr. <br />Kimmel's issues of support are as follows: <br />a. The comment period was extended to accommodate more comment on <br />the proposed project; <br />b. The sca/e of the operation is normal, phased for efficiency and the <br />impacts of noise, truck traffic and air quality mitigated by adhering to <br />Siaie Health Department standards; <br />c. Notifications of locations of pub/ic access to the app/ication were duly <br />made and the complete application has been available for some time; and <br />d.
