Domingue ~',~ <br />RE: Permit Area as of June 23~, 1982 <br />On September 21, 1979 Sunflower Energy Corporation applied for a <br />mining and reclamation permit with the Colorado Mined Land Reclamation <br />Board. On November 28, 1979 the permit was approved by board action <br />and bond was set at $25,000. The file on this permit is identified as <br />76-6/UG/C. <br />Clearly delineated on Exhibit B in bhe September 21, 1979 application <br />is a mineral lease area including all of lots 20 and 21, Sec. 35, <br />T12S, R91W. Copies of the lease agreement between Sunflower Energy <br />Corporation and United States Steel Corporation further indicate that <br />the eastern 184 feet of Lot 19, Sec. 35, T12S, R91W was available to <br />Sunflower Energy Corporation as of August 9, 1976. <br />Blue Ribbon Coal Company succeeded Sunflower Energy Corporation as the <br />operator of the Blue Ribbon mine on May 20, 1981. Several revisions to <br />permit 76-6/UG/C have been processed since that time. The latest <br />revision allowed Hlue Ribbon Coal Company to access coal in lints 16 <br />and 17, Sec. 35, T12S, R91W and expires on July 7, 1982. <br />At this time Blue Ribbon Coal Company is no longer operating in Lots 16 <br />and 17, Sec. 35, T12S, R91W. A letter, dated June 3, 1982, from <br />Marv Adams of Western Associated Coal (partner in Blue Ribbon Coal Company) <br />indicates that Blue Ribbon Coal Company is no longer operating north <br />of Lot 21, Sec. 35, T12S, R91W and is operating within the confines <br />specified in permit 76-6/UG/C. <br />Until permitted otherwise Blue Ribbon Coal Company must operate within <br />the areas designated in permit 76-6/UG/C. All of the rules developed <br />under the Act remain in effect for the operation. <br />
