II, Land Use - Rules 2.04.3, 2.05.5, and 4.15
The specific findings required under this section which were made in the
July, 1987 Findings Document (Renewal) have not been modified by proposed
PR No. 2 and remain applicable.
The proposed operation is in compliance with the requirements of this
section.
III. Cultural and Historic Resources - Rules 2.04,4 and 2.05.6(4
The specific findings required under this section which were made in the
July, 1987 Findings Document (Renewal) have not been modified by the
proposed revision and those findings remain applicable.
The proposed operation is in compliance with the requirements of this
section,
IV, Geology -Rules 2.04.5 and 2.04,6
Geologic information supplied by the operator in regard to the area of
proposed PR No. 2 appears on pages 14-16 of Section 2.04.6 of the permit
application package. This information indicates no significant
differences exist between the basic geology of the current permit area
and that of PR No. 2. With the exception noted below, the specific
findings required under this section which were made in the July, 1987
Findings Document (Renewal) are applicable to the area of PR No. 2,
Samples of coal waste from the existing storage area at the mine
submitted for analysis by the Division do not indicate the presence of
acid forming, toxic forming or alkalinity producing materials. It is
presumed that the coal and roof and floor rock will exhibit similar
characteristics.
Although proximate analyses of the coal have been submitted by the
operator, complete analyses of the coal seam and associated roof and
floor rock will need to be provided for verification purposes. The
following stipulation is therefore necessary:
Stipulation No. 06:
WITHIN 60 DAYS OF APPROVAL OF PERM I7 REVISION (PR) N0. 2,
NATIONAL KING COAL WILL SUBMIT THREE (3) SEPARATE CHEMICAL ANALYSES
THAT CONFORM WITH THE MLRD 1982 GUIDELINES FOR THE COLLECTION OF
BASELINE QUALITY AND OVERBURDEN GEOCHEMISTRY DATA AND ARE
REPRESENTATIVE OF THE COAL TO BE MINED IN PR NO, 2 AND OF THE
ASSOCIATED ROOF AND FLOOR MATERIALS. THE APPROXIMATE GEOGRAPHIC
LOCATIONS OF THESE SAMPLES WILL BE INDICATED ON REVISED COPIES OF
MAP C-10 FOR INCLUSION IN THE PERMIT PACKAGE.
With the acceptance of this stipulation by the operator, the proposed
operation is in compliance with the requirements of this section.
-4-
