<br />Bond Release [Phase lfl] Enron Coal [Northern Coal Co. - Meeker Mines] <br />CO/NERD Reg. Completeness Review [3.03.2 Release Procedures] <br />125(1)(1); 125(1)(A) and 125(1)(b) - copies of all public notices and <br />permittee newspaper notice provided. <br />*121(1)(c) The permittee's proof of publication was received by the <br />CO/NERD more than 30 days after the last publication [last publication: <br />3/26/87 - re e d. by MLRD: 7/30/87] <br />*125(2) No documentation that surface owner(s) were notified of the <br />bond release inspection date, prior to the inspection (7/14/87) <br />- surface owner notification of .inspection date is not documented in <br />Proposed Decision Findings. <br />*- Pg. 2 (Summary of the review process) - should read "site inspection <br />was held in accordance with [Rule 3.03.2(2)]" not [Rule 3.03.2(1)] <br />125(3) - No objections were received according to CO/NERD. <br />125(4) - No informal conference necessary as no objections to release <br />were received by CO/NERD. <br />125(5) - Decision by the Division <br />* - No documentation that the ~rmittee and "other interested parties" <br />were notified of the Proposed Decision within 30 days after <br />"completion" of the inspection. <br />- and evaluation required under 3.03.2(2) Inspection "conducted" <br />7/14/87. "Completion" date of "evaluation" is unknown. <br />* - OSM/AFO will need to see documentation (Proof of Publication) that <br />MLRD has 1) provided newspaper notification of its proposed decision, <br />2) provided written notification of the proposed decision, by certified <br />mail, to Rio Blanco board of county commissioners, and 3) that MLRD has <br />published its proposed decision in its monthly mailing under 1.03.2(2). <br />Additional notes: <br />There is no Federal property involved at the Wilson-Loudy loadout area. <br />The CO/NERD letter dated 2/24/87 to Mr. Greg Lewicki/Panorama Resources <br />indicates the bond release application [Meeker Area Mines - excluding <br />the loadout] was found to be "complete." As discussed with Sandy Brown <br />and Fred Banta at 8/28/87 meeting at OSM/AFO, the release application <br />should not be considered "complete" until the permittee's proof of <br />publication as required by 3.03.2(1)(c) is received by CO/NERD. <br />Please contact Henry Austin of AFO staff at (505) 474-1486 with any <br />questions concerning this review. <br />
