Czttany <br />Romeo, CO 81148 Division Director <br />is ~, / Natural Resource Trustee <br />Re: Gallegos Pit, Permit M-1983-164, Mined Land Reclamation Boazd Meeting, Outcome of Board Hearing, <br />and Conversion of Permit. -' <br />Deaz Mr. Gallegos, <br />The Mined Land Reclamation Board hearing that was held on May 11, 2005, resulted in the Boazd determining that <br />no violation for offsite damage or illegal mining had occurred at your gravel pit. The Division withdrew its request <br />for the Boazd to consider the possible violation at your pit. This action by the Board was mostly due to the fact <br />that, at the time of the hearing, the pernut was still issued to the Colorado Department of Transportation. The <br />Boazd, however, understood that offsite damage existed, and recognized the need to bring the offsite damage into <br />the permit. They directed this office to work with you to convert the existing 9.6-acre110 permit to a 112c permit <br />comprising more acreage. <br />The permit has recently been transferred to you, and this office can now proceed to assist you as the permittee, in <br />the permit conversion process. You have been sent an application packet that must be used for the 112c <br />conversion. Please review the packet, as well as the portions of the Rules and Regulations that are cited in the <br />packet. It is to be expected that there will be questions about the conversion application. I could schedule a visit to <br />your gravel pit to discuss the application process and the related requirements, or we could review it over the <br />telephone. I will, of course, assist you during the conversion application process, but I cannot prepaze the <br />application materials or exhibits. You might consider engaging the services of someone competent in preparing <br />permit applications to assist with at least portions of the paperwork. I can refer several names if needed. <br />Also please be reminded that, although the Board did not find a violation in this matter, the offsite damage still <br />exists, as well as the other conditions I had noted as problems in my 3/10/05 inspection report.
