Box 310 <br />San Luis, CO 81152-0310 <br />RE: MLRB Hearing November 17, 1993, San Luis Project, File No. <br />M-88-112 <br />Dear Mr. Kluksdahl: <br />On November 17, 1993, the Colorado Mined Land Reclamatio Board <br />conducted a hearing to consider a possible Notice of Vio ation for <br />BMRI's alleged failure to take appropriate precautions t prevent a <br />spill of process water outside of the primary containmen system. <br />This was the spill that occurred October 1, 1993 during ~ D.M.G. <br />monitoring inspection. The Board decided that the spill ', was not a <br />violation of your permit or the Act but directed BMRI to confer with <br />the Division to take whatever precautions are necessary t~o prevent <br />spills along the process water pipelines between the mile facility and <br />the completed portions of the tailings disposal facility: <br />In accordance with the Board's directive, please submit o the <br />Division a revision to your permit that includes a detai ed plan for <br />spill prevention including Bump shut-offs, valve lock-ou s and a <br />geomembrane-lined ditch system with positive drainage to and joined <br />with the tailings area disposal liner system. This plan is necessary <br />to minimize the potential for future spills due to const ction or <br />maintenance activities.
