In your memorandum you have indicated that <br />the Division of Water Resources could not recommend approval of Western Fuels-Utah's (WFU) <br />permit revision application prior to resolving the Gross-Nichols Ditch water right issue. <br />Please note that the Gross-Nichols Ditch water right issue has no bearing on the mine permit <br />revision application. WFU has been operating the Deserado Mine with existing valid water rights <br />for industrial use. The Gross-Nichols Ditch water right is currently valid for agricultural use. WFU <br />has requested the Water Court to change the nature of use of this water right from agricultural <br />to industrial, and also to change the source of the water to the existing surface pond. This pond <br />is the main source of Deserado Mine water need. WFU will not use the water from the Gross <br />Suite #305 <br />a05 U[ban Suee[ <br />Lakewood.
