Item seven in the luppa's letter requested that a pipe extending from a natural spring at the <br />east end of the pond be extended about six feet to the west to allow the spring to continue to <br />drain to the pond. EFCI committed to extend the pipe as per the landowners request. <br />Inspected, but not identified as a concern in the luppa's letter, is the nearby refuse well, part <br />of the approved hydrologic monitoring plan. Prior to final bond release approval, this well <br />should be abandoned and a well abandonment report submitted to the Division as per Rule <br />4.07. <br />EFCI also committed to re-arrange and re-shape a portion of the clean water diversion ditch <br />below the pond along the fence. Work here would consist of cleaning of a minor amount of <br />debris and movement of some of the riprap material to re-shape the channel (see photo <br />below). <br />Topsoil <br />Topsoil salvaged and stockpiled by the original operator, Sundance Coal Co., was extremely <br />{invited due to the extensive amount of pre-mining disturbance at the site. Following closure <br />of the mining operation and development of a final reclamation plan, topsoil was to be <br />replaced to a thickness of 4.5 inches. Prior to seeding the site, a comprehensive soil <br />sampling project was completed. Topsoil replacement thicknesses are included in a 1994 <br />report entitled "Soil Suitability Report, Raton Creek Mine Site". No topsoil stockpiles remain <br />at the mine, as noted during the inspection. <br />Partial completion of lowering of the emergency spillway <br />
