A copy
of that request has been provided for your review. The notice of violation was written for
failure to provide adequate drainage control on the Goat Trail Access Road at the Edna Mine,
and was issued on April S, 1993. The deadline for abatement was set for July 4, 1993, [he
maximum time permitted by Rule 5.03.2(2)(b). The abatement requirements consisted of two
steps: 1) submit a technical revision to revise the road drainage plan, and 2) implement the
plan within two weeks of Division approval. The respective due dates were May 20, 1993, and
July 4, 1993. P&M submitted the required revision on May 19, 1993. P&M received the
Division's adequacy concerns on June 14, 1993, and has not yet completed a response.
P&M would like an extension of 60 days on the abatement deadline, to September 2, 1993.
I believe this is a reasonable request which complies with Rule 5.03.2(2)(c)(i), since the
operator has applied for a technical revision in a timely fashion. Therefore, I am requesting
that you authorize such an extension.
SLM\062893B.WP
