i ~ <br />CEASE AND DESIST ORDER <br />Based upon the foregoing findings of fact and notice of violation, <br />and pursuant to the provisions of C.R.S. 1973, 34-32-123, the Board hereby <br />orders you to: <br />1. Immediately cease and desist all open mined sand and gravel <br />mining operations with the following exceptign: <br />The Board has approved removal of stockpiled material. <br />a •~ <br />2. Submit a complete permit application to the Board by <br />January 28-29, 1980, the next Mined Land Reclamation Board Meeting. <br />3. To give written notice within one (1) day after receipt of <br />this notice to the Mined Land Reclamation Board of your compliance with <br />paragraph one (1) of this cease and desist order. <br />In clarification of the rights of recipients of notices of viola- <br />tions, cease and desist orders, parties are advised to consult the Colorado <br />Mined Land Reclamation Act and the State Administration Procedure Act. <br />Nothing herein contained, particularly those portions requiring <br />certain acts to be performed within a certain time, shall be construed as <br />a permit or license either to violate any provisions of the Mined Land <br />Reclamation laws and regulations promulgated thereunder or to engage in <br />any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this <br />order are advised to consult C.R.S. 1973, 34-32-124(3), as amended (1976 <br />Session Laws, H.B. 1065). <br />Dated at Denver this 19th day of December 1980. <br />MINED LAND RECLAMATION 80ARD <br />Department of Natural Resources <br />BY Q~~.2~'~~ ~G~ <br />
