C <br />-3- <br />SCHEDULE TO NOTICE OF VIOLATION <br />Notice of Violation No. NOV C-92-007 <br />NATURE OF VIOLATION: <br />Failure to maintain a sediment pond outlet (West Mine Pond/NPDES Outfall 006) to <br />ensure compliance with applicable state and/or federal water quality standards <br />and the standards contained within NPDES Permit CO-0033685. <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />ACT SECTION(S) C.R.S. 34-33-120(j)(II)(A), C.R.S. 34-33-120(i)(II) <br />REGULATION SECTION(S) 4.05_.6{3)(a), 4.05.6(9), 4.05.1(3), 4.05.2(7), 4.05.5(1)(b) <br />PERMIT SECTION(S) Volume 8A, NPDES PERMIT APPENDIX <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br />West Mine Sediment Pond (NPDES Outfall 006) <br />(Outfall riser was found.~to be leaking, and a sample of effluent was taken from <br />be 90 mg/I, of total <br />suspended solids, apparently exceeding the maximum allowable standard of 70 mg/L, <br />as specified in NPDES Permit CO-0033685. <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br />(1) Repair outlet to ensure proper function. <br />(2) Submit a P.E. certification which verifies that the outlet has been repaired <br />to ensure proper function. <br />TIME FOR ABATEMENT (NOT MORE THAN 90 DAYS): <br />ON OR BEFORE June 5 19 92 <br />(11 Repair outlet.
