Lamm Governor December 4, 1985 Mr. Douglas Bachli 6925 1/2 Lowell Blvd. Denver, Colorado 80221 RE: Unpermitted stone quarry - Sec 2, T6N, R70W, Lorimer County Dear Mr. Bachli: It has come to our attention that you are conducting an unpermitti operation at the above-described location. mining All mining operators are required to obtain mining and reclamatio permits for their mining operations in Colorado by the Colorado Mined Land Re lamation Act, C.R.S. 34-32-101 et seq., and specifically, 34-32-109(1), as amended. The Mined Land Reclamation Division has placed you and your opera ion on the Mined Land Reclamation Board meeting agenda for consideration of ossible violation of the above mentioned statute. This meeting is schedu ed for December 18-19, 1985, in Room 110 of 1313 Sherman St., Denver, Co orado, commencing at 9:00 a.m. each day. Your matter wi17 be heard as s on after commencement as possible. Please call this office on December 16 1985 for a more specific day and time. At the meeting the Board may issue a Cease and Desist Order for your operation at the above cited location per Article 32 of Title 34, Section 1 3 (1) and (2) which states: (1) "Whenever an operator or prospector fails to obtain a vali permit or file a notice of intent under the provisions of this articl ,the board may issue an immediate cease and desist order. Concurrentl with the issuance of such an order, the board may seek a restrainin order or injunction pursuant to Section 34-32-124(3).
