Long <br />RE: Response to Qlrestioos Concerning RobeR ICrassa's Letters of February 22, 1994 and ofvition o~recior <br />February 25, 1994 and ]eff Desautel's Letter of February 24, 1994, Basin Resources, Inc., <br />The Golden Eagle Mine, Permit No. C-81-013 <br />Per your request last week, I reviewed Bob Krassa's and Jeff Desautel's February 1994 memos regarding the <br />Golden Eagle Mine. I'd Tike to provide the following respoous. <br />ICrassa's Letter of February 25. 1994 <br />Your fast question concernod Mr. Krassa's comments in Paragraph No. 2 regarding We surface owners <br />overlying the Golden Eagle Miue, and the location of their properties that he alleges an missing from the <br />Surface Ovmer's Map. <br />At the February 2'3, 1994 meeting at which representatives of the Division, Basin Resources and <br />p Ratan West met, m updated Stirrfea Ownership Man was submitted to the Division by the opeiator. <br />/~l'\ Most of the information appeated correct to Ratan Wesl though at least one error was identified. The <br />Division has asked the two paRies to coordinate on This matter. Additionally, the Division is asking <br />the two parties to agrx on a cutoff date of January 21, 1994 for the surface ownership information. <br />Finally, we have asked Basin W submit Surface Ownership Maps [o the Division on a <br />quarterly basis. <br />The next gtustion pertained to the status of the submittals that Mr. ICrassa, in his Paragraph No. 3, stated <br />were missing. <br />The submittals were due on January 21, 1994. This day was a holiday, so the items were delivered <br />on January 22, 1994. Mr. Carl Getity, representing Raton Wes[, was unable to come to the office <br />that day. He telephoned the office that day and requested copies of the submittals mailed to him. <br />This was done; however, the mailed copies did not arrive to him in time before the January 23, 1994 <br />mceting. On January 23, 1994, Mr. Gerity picked up some of the material, and the remaining <br />material was mailed again to him. The submittals of January 22, 1994 were reviewed by the Division <br />and an adequacy letter was sent on March 4, 1994. <br />The next question, pertaining W Mr. Krassa's comments in Paragraph No. 4, asked if all maps encompassed <br />the eatiro permit arta, parucularly the post-mining land use map, and whether this was caught during the <br />Division's review of the permit renewal: <br />Not all maps submitted for underground mining operations are required to identify the permit <br />boundary. Rule 2.10.1(3) states 'All maps shall show the permit area boundaries where the area of <br />the map covers the boundaries." <br />
