Subsequently, on Monday, October 19, 1992, we were <br />inspected by an MSHA team due to the above concern. Pursuant to <br />that inspection, MSHA mandated that we reduce the highwall slopes <br />within a short time frame, in order to mitigate a potentially <br />life threatening situation. <br />Due to the nature of this emergency we are requesting that we be <br />allowed, through your administrative decision, to increase the <br />outer limits of our excavated slopes to the east, by as much as <br />200'. This increased excavation lies well within our M-C Zoned <br />boundary, but lies east of the approved limit of excavation. The <br />approval of this increased limit of excavation will not alter the <br />visual impact of the Quarry to the residents east of us. The <br />urgency of this situation requires an answer from the County by <br />October 28, 1992. We are concurrently seeking approval from <br />MLRD, and because of the emergency nature of our request, expect <br />immediate approval. <br />Prior to Wednesday, October 28, we would welcome a site tour by <br />the County staff, so that the new limit of excavation can be <br />physically observed within the Quarry. <br />We appreciate your help and concern in this matter and understand <br />your difficulty in reaching this short time frame. However, the <br />gravity of the situation requires this. <br />
