Long <br />RE: Bowie Mine No. 1, File No. C-81-038, Notice of Violation Division Director <br />C-95-004 <br />This memo is written to request an extension beyond 90 days for the <br />abatement of NOV C-95-004. The violation was written for failure <br />to declare all owners and controllers at the Bowie Mine No. 1 <br />during a recent transfer of permit from Cyprus Orchard Valley Coal <br />Company to Bowie Resources Limited. The abatement was to submit a <br />technical revision to incorporate all owners and controllers and to <br />effect full compliance (ie, receive approval for the TR). <br />The operator did submit a revision and has responded to outstanding <br />adequacy questions in a timely manner. This revision essentially <br />made Bowie Resources the clear operator of the mine, however, just <br />prior to approving the revision it came to the Division's attention <br />that a new operator was close to making a deal with Bowie to <br />operate the mine. This new operator is a new company consisting of <br />several of the Bear brothers. Since we had not yet approved the <br />revision and it was clear that yet another operator would have to <br />be added to the system, we decided to hold the revision open to add <br />the new operator and avoid duplicating the effort. Unfortunately, <br />before this will be formally approved (public notice timeframes <br />elapsed) we will have gone beyond 90 days from the time the <br />violation was issued. Therefore, the Division would like to extend <br />the 90 day abatement by 30 days (to July 12, 1995) This should <br />be more than adequate time to complete the revision as all the <br />information is now in hand and ready for approval.
