Similar issues were addressed at a <br />December 15, 1993, hearing before the Colorado Land <br />Reclamation Board. I am enclosing for your review a copy of <br />"Request for Party Status and Exhibits" presented at this <br />hearing on behalf of Raton West - Baldwin Ltd. Development. <br />While much of this information in this package does not <br />apply to our complaints, some of it is relevant. I have <br />marked our home site in red. our fine old ( 60 plus years) <br />adobe home is now showing subsidence and much damage whereby <br />it had no such problem. before the mine came under our <br />property. <br />The mine continues to evade their responsibilities and <br />obligations to abide by the law. Enclosed is a copy of the <br />October 26, 1993, memos from Steven Renner to Michael Long. <br />In total, 26 Notices of Violations were issued to Sasin. <br />,_, Renner states "The Division believes that these Notices of <br />Violations and one Imminent Harm Cessation Order .do not <br />represent isolated departures trom lawful conduct, but <br />rather a broad, overall lack of concern with regulatory. <br />compliance by the permittee." "The Division further <br />believes these ~ialations were caused by the unwarranted <br />failure of the permittee to comply with the requirements of <br />the Act, Rules and permit conditions. Therefore, I <br />recommend that you concur with the staff determination that <br />a Pattern of Violations exists at this mine." <br />The mine did not secure a Las Animas county building <br />permit for the exhaust shaft on our property until 6 - 12 <br />months after"the installation was installed and until the <br />mine was threatened by the Las Animas County Planner's <br />Office. While I understand that this violation of the law <br />is not under the jurisdiction of the Division, it does <br />display the mine's basic total disregard for the law and the <br />rules. <br />What assurance do we have that the information the <br />mine provided us with regard to the distance from our home <br />to the ^First Mine" is correct'! We were first told the <br />mine was 750 feet from our home, then later advised they <br />were 200 to 30o plus feet from our home. we know that the <br /> <br />
