The <br />cause and repair plan was submitted as required. The other <br />abatement step was to effect on the ground repairs by July 15, <br />1993. The NOV was issued on April 16th, therefore the time allowed <br />for abatement was 90 days. <br />The toe of the slide is still saturated. The french drain <br />installed at the top of the slide is still draining water. The <br />physical condition of the slide, caused by climatic conditions, <br />precludes performing on the ground repairs by July 15th. The slump <br />area must be allowed to dry prior to performing the approved repair <br />plan. <br />Rule 5.03.2(2)(c)(iv) provides for the extension of the abatement <br />period when climatic conditions preclude abatement within 90 days. <br />Please extend the abatement deadline for the referenced NOV to <br />August 13, 1993 to allow the slide additional time to dry.
