ASPHALT <br />SPECIALTIES CO. <br />Exhibit S -Permanent Man-Made Structures <br />Permanent man-made structures located within 200 ft. of the area to be mined in the <br />amendment area, for which this application is being submitted, are shown on Exhibit C-3, <br />Adjoining Property Owners Map. All structures are shown by an outline/symbol that is <br />identified in the Legend on the map. All structures are shown within identified tax parcel <br />lots/numbers with names and mailing addresses. There are five property owners with <br />structures located within 200 ft. of the mining limits in the amendment azea. Prior to <br />mining within 200 ft. of these structures, ASCI will obtain signed and notarized <br />agreements with the structure owner that will allow us to mine within 200 ft. of the <br />structure. Initial contact has been made with the landowners of these structures and <br />ASCI feels confident that agreements can be reached with all of the owners. <br />ASCI has completed agreements for mining within 200 ft. of permanent man-made <br />structures with all of the landowners required to mine within 200 ft., for the present area <br />of mining on the current Speer Mining Resource permit area. These agreements have <br />been forwarded to the CDMG to be placed in the permit file. The remaining two structure <br />owners will sign the agreements prior to mining within 200 ft. of their structures. <br />Although this is not expected to occur for several more years, the agreements will be <br />forthcoming shortly. <br />Speer Mining Resource 2S October 7, 2002 <br />Asphalt Specialties Company, Inc.
