<br />Therefore the following stipulation is made: <br />Stipulation No. 08: <br />WITHIN 60 DAYS OF APPROVAL OF PERMIT REVISION (PR) 03, NATIONAL <br />KING COAL WILL SUBMIT A PLAN IN THE FORM OF A TECHNICAL REVISION TO <br />THE PERMIT THAT SHALL INCLUDE CHANGES TO THE PRIMARY AND EMERGENCY <br />SPILLWAYS OF EACH POND AND INCORPORATE ROUTING CHANGES TO THE EAST <br />DRAINAGE DITCH. THE PLAN SHALL COMPLY WITH THE APPLICABLE PORTIONS <br />OF RULES 4.05.4, 4.05.5, 4.05.6, 4.05.7, AND 4.05.9. <br />With the acceptance of this stipulation b.V the operator, the proposed <br />operation is in compliance with the requirements of this section. <br />VII. Water Rights and Replacement - Rules 2.04.7(3), 2.05,6(3)(a)(iii <br />There are no additional impacts on ground or surface water anticipated as <br />a result of mining in the area of PR-03. There are no changes in the <br />commitment made by the mine to effect repairs to the Huntington <br />Irrigation Ditch should the mining operation impact the structure. The <br />specific findings made in this section of the July, 1987 Findings <br />Document (Renewal) therefore, are applicable to the proposed future <br />mining operation. <br />The proposed operation is in compliance with the requirements of this <br />section. <br />VIII. Alluvial Valley floors -Rules 2.06.8, 2.07.6(2)(k) and 4.24 <br />The specific findings made in regard to Ha.v Gulch in the July, 1987 <br />Findings Document (Renewal) and the findings made in regard to Pine Gulch <br />in the August 15, 1990 Findings Document for PR-02 are not altered by <br />proposed AR-03 and remain applicable for each drainage. <br />The proposed operation is in compliance with the requirements of this <br />section. <br />IX. Assessment of Probable Hydrological Consequences of Mining and Cumulative <br />u..a~,.i..,.;,. rm,.~,.+.. o.n.... ~ nc c~~~ ,..J ~ m c o .. <br />A. Probable Hydrologic Consequences <br />This section assesses the effects that the proposed future operation of <br />the Kinq Coal Mine, which will include the area of PR-03, will have on <br />the surface and ground water s.vstems within and ad.lacent to the mine area. <br />-6- <br />
