C-93-113. and C-93-114 <br />Dear Sir or Madam: <br />,b <br />r+~CEIVED <br />SEP 2 0 199, <br />.,. ,~~ne~a~s a neology <br />On August 12, 1993, the Colorado Division of Minerals and Geology ("Division") <br />issued three Notices of Violation ("NOVs") to Mountain Coal Company's West Elk <br />Mine. NOV C-93-112 alleges that Mountain Coal Company failed to provide proper <br />notice to surface land owners prior to mining in 1985. NOV C-93-113 alleges that <br />Mountain Coal Company failed to secure Division approval prior to consolidating <br />topsoil stockpiles at the West Elk Mine. Finally, NOV C-93-114 alleges that an area <br />of land near the base of the coal refuse pile is an unpermitted light use road. <br />Mountain Coal Company contests each of these allegations, and has requested that <br />the Division vacate all three NOVs. A copy of Mountain Coal Company's request to <br />the Division is attached for your review. That document sets forth the basis for <br />Mountain Coal Company's claim that these NOVs should be vacated. <br />At present, the Division has not vacated these NOVs. Mountain Coal Company <br />therefore requests that the Board formally review NOVs C-93-112, C-93-113, and <br />C-93-114 at its October meeting.
