As you know, we take our responsibilities for environmental compliance very
seriously and work hard to make sure our operations are in good order and full compliance.
In reviewing the NOV's and supporting documentation, we have identified same concerns, and areas
where we feel that it is appropriate to provide the Division with relevant information for your consideration.
Specifically, we are providing discussions and documentation addressing the appropriateness of Parts 1
and 2 of NOV CV-2005-006, and based on these discussionsldocumentation, requesting that these two
Parts of the NOV be vacated. In addition, we are providing relevant discussions and documentation for
the remaining Parts of NOV CV-2005006 and both Parts of NOV CV-2005-005, for your consideration in
evaluating seriousness, fault, and good faith relative to the alleged violations.
When any issues or concerns are identified for our operations (either internally or by outside parties), it is
our standard policy to evaluate and address the issueslconcerns in a timely manner. We are having
ongoing discussions with Byron Walker, the designated Reclamation Specialist for the Foidel Creek Mine,
and are proceeding with appropriate abatement measures to address any immediate concerns and
prevent the recurrence of similar problems in the future.
We appreciate your con eration and would be happy to discuss any related questions with you Please
feel free to contact m970) 870-2712 -
Best regards,
Jerry

NOV CV-2005.005 Rel.
