• <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: The City of Monte Vista> <br />720 1st Avenue ) <br />Monte Vista, CO 81144 ) <br />To t;ne City of Monte Vista and all other persons engaged in <br />controlling the Lagoon Pit mining operation located in SWNW, <br />Township 39N, Range 8E of the N.M.P.M., in Rio Grande County <br />FINDINGS OF FACT <br />NOTICE AND <br />ORDER TO PAY <br />CIVIL PENALTY <br />or owning or <br />Section 32, <br />Colorado. <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-123, the Board hereby makes the following <br />findings of fact: <br />1. On May 28, 1992 the Board conducted a hearing and found the City of <br />Monte Vista to be conducting the mining operation described above without a <br />permit as required by C.R.S. 34-32-101 et seq. <br />2. On June 3, 1992 the Board issued Notice of Violation M-92-034 and Cease <br />and Desist Order to the City of Monte Vista. <br />3. On October 21, 1992 the Board conducted a hearing in accordance ~.vith <br />C.R.S. 24-4-101 et >eq. to consider assessment of civil penalities against the <br />City of Monte Vista. <br />4. The Division of Minerals and Geology presented evidence at the Formal <br />Public Hearing on October 21, 1992, demonstrating that: <br />The City of Monte Vista had secured approval of a permit application for <br />the Lagoon Pit as required by the Board. <br />
