NOV C-93-122 <br />Golden Eagle Mine <br />This NOV was issued for failure to treat mine water discharge to <br />meet effluent limits and prevent damage to the hydrologic balance. <br />HISTORY <br />Nine NOV's and one CO have been issued at this mine in the past <br />twelve months. A $50 assessment for each NOV and $250 assessment <br />for each CO is required by regulation. $700 is assessed for <br />history. <br />SERIOUSNESS <br />Coal was deposited in an ephemeral stream passing through the <br />permit area. At the time of the inspection, approximately 1300 <br />feet of the stream had visible amounts of coal in it. This stream <br />empties into the Purgatoire River when it leaves the permit area. <br />The amount of disturbance to the river is unknown however, addition <br />of the coal and coal fines certainly would have had some short term <br />impact on the river. Because of the extent of disturbance in the <br />permit area $1000.00 is assessed for seriousness. <br />FAULT <br />The problem with water treatment apparently resulted from a pump <br />failure. The operator appears to have responded to the pump <br />problem in a timely manner, once the problem was discovered. <br />However, pond discharge was apparently not monitored closely enough <br />to detect the effluent problem when it first occurred. $500 is <br />assessed for negligence. <br />GOOD FAITH <br />The operator appears to have responded rapidly to the problems <br />identified with the pump and pond. $250 is awarded for good faith. <br />c:\wp51\101493b <br />
