<br />U.S. Forest Service <br />Gunnison National Forest <br />2250 Hwy 50 <br />Delta, Colorado 81416 <br />Re: Notification of Mining Schedule <br />Oxbow Mining, LLC., CDMG Permit No. C-1981-022 <br />To Whom It May Concern: <br /> <br />Colorado Division of Minerals and Geology (CDMG) Rule 4.20.2 requires that Oxbow Mining, <br />LLC's mining schedule be mailed to all owners of property and residents within the area above <br />the underground workings and adjacent areas. Each such person shall be notified by mail at <br />least six months prior to mining beneath his or her property or residence. The regulations require <br />that the notification contain the following three items: <br />1. Identification of specific areas in which mining will take place and <br />2. Dates of mining activities that could cause subsidence and effect specific <br />structures. <br />The attached map 2.05-M2 titled Elk Creek Mine, 5-Year Mining Plan and Surface Property <br />Owners provides information regarding the areas and dates in which coal mining activities will <br />take place. <br />3. Measures to be taken to prevent or control adverse surface effects. <br />The Oxbow Mining, LLC. Mining and Reclamation Permit referenced above describes the <br />extensive measures and mitigation plans to prevent, control or minimize potential adverse mining <br />related impacts on air, fish and wildlife, hydrologic, specially designated public lands, other lands <br />and other surface resources. The detailed plans reflect the application of the best technology and <br />methods currently available and are designed to effect full compliance with all applicable <br />regulatory requirements.
