Therefore, it may be that <br />some or all of these species do not presently occupy or use the project area, and/or that habitats <br />for these species do not exist within the project area. <br />Regazding Federal candidates for official listing as threatened or endangered, these species <br />presently have no legal protection under the ESA, but it is within the spirit of the Act to consider <br />project impacts to these potentially sensitive species. We also wish to make you awaze of their <br />potential presence because of the possibility that one or more could be proposed or listed prior to <br />the time that all actions related to the project aze completed. <br />Your letter requests Service comments by January 14, 2006, or you will proceed on the <br />assumption that the Service has no concerns with or objections to the proposed action. We note <br />the Service's position on a project cannot be assumed without our official response. At this time, <br />the Federal action agency or its designated representative have not provided the Service with an <br />evaluation of the potential effects of the project on threatened or endangered species, and their <br />habitats. It is your responsibility or that of the Federal action agency to do so. If this assessment <br />contains sufficient information, and contains conclusions of effect for each of the 8 threatened <br />and endangered species under consideration, the Service will respond timely with a decision <br />regarding your conclusions. _ <br />We hope this provides you with helpful guidance.
