Cottony <br />Division Director <br />Natural Resource Trustee <br />After we sent out the preliminary adequacy review for the McClane RN-6 renewal <br />application, we received a comment letter from the U.S. Fish and Wildlife Service <br />(USFWS). A copy of their letter is enclosed. In order for us to respond to the concerns <br />raised by the USFWS letter, we are requesting that sections of the permit application <br />addressing potential effects to threatened and endangered species be updated in the <br />context of the permit renewal review. We are requesting that potential effects to <br />candidate species be addressed as well, to ensure that any conflicts that might be posed <br />by future species listings can be identified and addressed. This request is set forth in <br />Adequacy Review Item 21, below. <br />21. Adequate information needs to be included in the application to support required <br />findings of the Division that the activities would not affect the continued <br />existence of endangered or threatened species of plants or animals, or result in <br />adverse modification of their critical habitats as determined under the Endangered <br />Species Act. <br />A current list of federal threatened and endangered species and candidates for <br />potential future listing is provided in the letter from USFWS. The list is from an <br />inventory of Garfield County. Please update Section 4.3.8 of the application to <br />address the current status of each of the listed (T&E) and candidate (C) animal <br />species, with respect to potential occurrence within the permit area and potential <br />for impacts associated with the operation.
