Dear Mr. Smythe:
Action by the Colorado Mined Land Reclamation Board at their meeting resulted
in a finding that there is reason to believe that a violation to the permit
for the above captioned operation has occurred (as per C.R.S. 34-32-124(1)).
This matter will be on the Board agenda as a Formal Public Hearing during the
Board meeting of February 27-28, 1985 for consideration of the possible
violation and possible cease and desist order on this operation, and possible
corrective action(s) for the violation.
At the hearing, which will be held in Room 110 of 1313 Sherman Street, Denver,
Colorado beginning at 9:00 a.m. each day, you will have the opportunity to be
represented and heard. It will be reiterated that you have been in violation
of the permit and the Mined Land Reclamation Act, specifically as follows:
1. Condition 1 on page 2 of Mining and Reclamation Permit No. 83-89,
which states: "The operator agrees to be bound by all applicable
requirements of the Act and all applicable rules and regulations of the
Board, as amended from time to time".
2. C.R.S. 34-32-117(6)(a) which states in pertinent part: "Financial
warranties shall be maintained in good standing for the entire life of
any permit issued under this article".
