Caltany <br />Division Director <br />Natural ReypyA7e Truspae <br />On June 6, 2006, the Division of Minerals and Geology conducted an inspection of the Berthoud Sunset Quarry, <br />Permit No. M-1994-080. The Division currently holds a bond in the form of a Letter of Credit (#3158 issued by <br />the First National Bank of Fort Collins) in the amount of $4,635.70- <br />According to Rule 42.1(1) and (2), the Division may review a ftnamcial warranty at any time to deternlioe if the <br />amount is sufficient to perform reclamation. The Division reeaIcvlated the bond to factor in the current disturbance <br />and what is required to achieve the approved postmirting land use of rangeland, The result of the recalculation <br />indicates that the site is currently underbonded. This letter is tv inform you that your financial warranty wi11 need <br />to be revised from its current amount of $4,635.70 to $34,800.00 within 60 days of receipt of this letter. A copy of <br />calculations used to determine this cost is attached for your review. The operator has three options regarding the <br />amount of required bond; <br />l- submit additional financial warranty in the amount of $30,164.30, <br />2. perform some reclatation on the site to reduce the reclaration liability, or <br />3, revise the reclatnatian plan. <br />One of the three options roust be completed by September 15, 200b. Failure to do so may be considered a violation <br />of the Construction Material Rules and Regulations.
