Box 1093 <br />Craig, Colorado 81626 <br />Re: Rock Pit, File No. M-85-082 <br />Dear Messrs. Knez and Levkulich: <br />Action taken by the Mined Land Reclamation Board on November 25, 1985, was to <br />continue consideration of a Notice of Violation and Civil Penalties for <br />continuing to have a mining operation without a permit (a violation of CRS <br />34-32-123). The basis for this continuance was due to a telephone <br />conversation with Dennis Benigar of the Farm Bureau Insurance specifying that <br />the Denver office had just issued a $5,000.00 surety (by Allied Fidelity). <br />Mr. Benigar specified that the $5,000.00 Financial warranty should be posted <br />with this office by Friday, November 29, 1985. <br />Based on this information, (of a timely submittal of the necessary Performance <br />and Financial Warranties) the Board agreed to continue this hearing to the <br />December 18-19, 1985 meeting. If, in fact, the necessary properly executed <br />Performance and $5,000.00 Financial Warranty forms are received and the permit <br />for this site is issued, this hearing will be withdrawn (ie. the above <br />mentioned violation and civil penalties will not be considered). <br />By now you should have received the resent letter dated October 29, 1985 <br />providing information about the proposed hearing. Please be advised that the <br />hearing is now scheduled for December 18-19, 1985 commencing at 9:00 a.m. or <br />as soon thereafter as possible in Room 110 of 1313 Sherman Street, Denver, <br />Colorado. This hearing will be held in compliance with the State <br />Administrative Procedure Act (Article 4 of Title 24, CRS) and the Board will <br />consider a Notice of Violation, Civil Penalties, and corrective actions for <br />the continued violation to CRS 34-32-123 (mining without a permit). <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
