State of Colorado <br />Charles Shows, being first duly sworn upon oath hereby affirms and swears as follows: <br />I . I ate the record Owner of a tract of land by virtue of a recorded deed dated July' 7'h, 1998 a copy of which <br />is attached hereto as exhibit "A" and which is a true and correct copy of the same. <br />2. 1 reside at 38-700 Vista Dr. Cathederal City, CA 92234. <br />3. I am aware that my property is adjacent to that property owned by Costilla County and which has been <br />operated as a gravel pit location. <br />4. !have my property under contract of sale to Kenneth Hershey; further that Mr. Hershey is, I believe, in <br />default under the terms of that agreement and have instructed my attorney, Bruce ). Meyer, Esq. of Alamosa, <br />CO, 81101 to initiate procedures necessary to enforce the terms of that contract andlor remove Mr. Hershey as <br />an interested person regarding said property. <br />S. I have been made aware of certain reclamation activities done by the Costilla County which "spilled" onto <br />my land. I am specifically aware of the December 27, 19991etter by Michael B. Long to Costilla County which <br />outlines these activities and position of the Division of Minerals and Geology regazding these activities on my <br />land. <br />6.
