On ~~~ ~,~ ~, 19 ~~ ~ the Mined Land Reclamation <br />Board or Division of the Colorado Department of Natural Resources <br />("the state") granted to Quillen Company, a Colorado corporation <br />5cIDnxnfhgtx~ficxxx xxxxxxxxxxxxxxxxxxxxxxxx~toDmFx6~fl0cScex7~c <br />("permittee").permit number 77-57 ("the permit") pur- <br />suant to which permittee has been conducting a surface mining <br />operation in the County of _ Moffat State of Colorado. <br />B. Permittee wishes to assign the permit to Craig Contracting <br />cnr~}.. a Colorado corooration aQ:~cxxxxxxxxxxxxxxxxxxxxxxxxxxx~4AxHHEX <br />t~x5;5;gpx~cx as successor operator ( "suc- <br />cessor") and successor wishes to become successor permittee under <br />tie permit. <br />C. Successor understands that the reclamation plan ("the <br />?an") required by the permit and by applicable state laws and <br />=e;ulations has not been completed and is willing to assume full <br />:es:onsibility for the completio^ of the plan. <br />II. <br />AGR .E~ NTS <br />Permittee and successor hereby agree, for their own benefit <br />and for the benefit of the state, such agreements to be effective <br />ipso facto upon the approval by the state of the transfer of the <br />o=r..r...'_t from permittee to successor, as follows: <br />_. Successor has inspected the mining and reclamation opera- <br />t=cas to its entire satisfaction and is fully aware of the con- <br />~.-_-: thereof. Successor understands and accents all of the con- <br />==:__s of the permit. <br />2. Successor will complete the reclamation plan, and hereby <br />assures liability for completing such plan as to all areas hereto- <br />fore disturbed as well as to all areas hereafter disturbed. Suc- <br />cessor will perform all of the obligations of the permittee under <br />the permit which have not heretofore been performed by permittee. <br />3.
