2 Objection was given to you--we stated 4 grounds, as a matter
3 'of law, there was an objection, which clearly the notice prob-
4 lem' s in violation of law, you were put on notice that there
5 was a series of objections here, we are under no obligation
6 to do so, but we did so. And we are appearing here today to
7 explain this to you and to try to shortcut whatever proceed-
g ings we might have to go through in order to resolve this to
9 the interest of our client.
JORW: Do you have an explanation why there was not included in here
11 the deficiency of notice.
12G: I don' t know because at the time Mr. Stemwedel wrote that
13 letter I don' t know the particular situation. But it' s talk-
14 ing about that in the last couple of days. It seems that he
15 was trying to [unintelligible] at the time he realized Eagle
16 River was affected--why would he get something out here to
17 protect him and he didn' t have time. out in Eagle, Colorado
18 they 're not up on the latest version of the Board Mined Land
19 Reclamation Regulations he just knew, well I should get these
20 objections out to you, so you know that we have some objections,
21 here, so we can appear before the Board to present this.

23MH: The next day, Feb. 17, I was in Glenwood, I called Mr. Stem-
24 wedel and I asked him you know what' s the nature of your
25 objections because I just wanted to know, I hadn' t received a
26 letter yet, but I talked to his secretary the day before, he
27 had called down here and talked to Bob, and I called his
28 secretary and they informed me that there was a letter of
29 objection so I wanted to find out what his objections were,
