considered I was contacted by Mr. William Goldstein who <br /> identified himself as an attorney representing The Eagle <br /> River 1978 Trust. In my conversation with Mr. Goldstein he <br /> complained that the Trust had not received proper notice of <br /> the Nottingham Sand and Gravel Company application. This is <br /> the first time any representative of the Trust complained of <br /> improper notice. <br /> 12. I also asked Mr. Goldstein if he could elabo- <br /> rate on the objections made by Mr. Stemwedel , which he could <br /> not. <br /> 13. Mr. Goldstein never made any request for a <br /> hearing on the Nottingham Sand and Gravel Company applica- <br /> tion during my conversations with him prior to the March 1 <br /> Board meeting. <br /> 14. It is customary for the Board to act on several <br /> permit applications during the two days set aside each month <br /> for their meetings. Unless a hearing .is requested, Board <br /> consideration of a permit application is relatively in- <br /> formal. The Reclamation Specialist assigned to review the <br /> application describes the reclamation plan and the operation <br /> for which a permit is sought and makes a recommendation on <br /> permit issuance or denial. Any objectors to the applica- <br /> tion are then heard and, after Board Members have questioned <br /> the applicant, the Reclamation Specialist and any objectors, <br /> a vote is taken. This is precisely how the Nottingham Sand <br /> and Gravel Company application was handled. I fully des- <br /> cribed the application to the Board and recommended that a <br /> permit be granted based upon my opinion that the application <br /> satisfied all applicable requirements of the Mined Land <br /> Reclamation Act. <br /> 15. Mr. Goldstein attended the March l meeting on <br /> behalf of the Trust. Following my presentation and the con- <br /> sideration of another objection, Mr. Goldstein complained to <br /> the Board that the Trust had not received proper notice <br /> -3- <br />
