considered I was contacted by Mr. William Goldstein who
identified himself as an attorney representing The Eagle
River 1978 Trust. In my conversation with Mr. Goldstein he
complained that the Trust had not received proper notice of
the Nottingham Sand and Gravel Company application. This is
the first time any representative of the Trust complained of
improper notice.
12. I also asked Mr. Goldstein if he could elabo-
rate on the objections made by Mr. Stemwedel , which he could
not.
13. Mr. Goldstein never made any request for a
hearing on the Nottingham Sand and Gravel Company applica-
tion during my conversations with him prior to the March 1
Board meeting.
14. It is customary for the Board to act on several
permit applications during the two days set aside each month
for their meetings. Unless a hearing .is requested, Board
consideration of a permit application is relatively in-
formal. The Reclamation Specialist assigned to review the
application describes the reclamation plan and the operation
for which a permit is sought and makes a recommendation on
permit issuance or denial. Any objectors to the applica-
tion are then heard and, after Board Members have questioned
the applicant, the Reclamation Specialist and any objectors,
a vote is taken. This is precisely how the Nottingham Sand
and Gravel Company application was handled. I fully des-
cribed the application to the Board and recommended that a
permit be granted based upon my opinion that the application
satisfied all applicable requirements of the Mined Land
Reclamation Act.
15. Mr. Goldstein attended the March l meeting on
behalf of the Trust. Following my presentation and the con-
sideration of another objection, Mr. Goldstein complained to
the Board that the Trust had not received proper notice
-3-
