It never has been a public crossing and when they <br /> 20 first proposed--I think it was the Brush Creek and the Eagle <br /> 21 River Co.--started some mining operations down there they <br /> 22 were the predecessor to Nottingham or Nottingham was involved <br /> 23 I don' t know exactly the legal technicality, but they started <br /> 24 using our crossing without our permission. This crossing <br /> 25 wasn' t built to accommodate these heavily laden trucks that <br /> 26 cross at this particular crossing. And I would like to <br /> 27 emphasize also there' s not just one track here there are two <br /> 28 tracks. There' s our main line track that' s parallel by a <br /> 29 passing track. This particular area has a speed limit of <br /> -7- <br />
