Your file #79-53 <br />Dear Carol: <br />As you know, the above referenced NOV's required specific action <br />on the part of TBM to abate the violation in the required tiem period. <br />I am pleased to inform you that all the violations have been abated <br />as of this date, either thru on the ground measures or incorporating <br />these areas into a new mining and reclamation sequence. The violations <br />are as follows: <br />Violation 80-4a: The mine plan has been revised in relation to this <br />violation. In the August 29th sukznittal, this area was referred to <br />as overburden stockpile #4 and the final status of this area generated <br />sore concern on your parr.. TBM has revised its mining and reclamation <br />plan for this area to satisfy your concerns. 'The approximately 15,000 <br />yards of material contained in this area will be used in the construction <br />of the haul road leading into the mining area. Specifically the <br />material will be used in the area of sediment pond 22-P10, if all the <br />excess material is not used in this construction area, it will be <br />stockpiled for final deposition in cut 11. However, before the over- <br />burden material is removed the area wdll be stripped of the topsoil <br />that had been reapplied. This topsoil will be temporarily stockpiled <br />in topsoil stockpile #1. After the excess overburden is removed the <br />topsoil will be reapplied and the area reclaimed per the approved plan. <br />This work will be completed by C>rtober 10, 1980. <br />Violation 80-46: This violation will be abated once approval for <br />mining to the west is approved by your office. Once the mining begins in <br />this area this will be the first pit to be back filled and reclaimed <br />as per the reclamation schedule. Our discussions have indicated that <br />it is not logical to fill this pit at this time if mining is to proceed <br />P. O. Box 758, Golden, Colorado 80401 Telephone (303) 278-8665 <br />
