TBM agrees with this reasoning and will <br />perform all reclamation as per the approved plan. <br />Violation 80-4C: This violation has been abated. <br />Violation 60-9d: This violation identifies sediment #10 as riot being <br />constructed as per the approved plan. It should be noted that sediment <br />pond #10 as drawn on Exhibit C, said exhibit prepared under the direction <br />of Idobert Feder, does not exist on map 8009-SCI. Pond #10 has been <br />replaced by pond 22-P9 and as of this date this pond is in place. <br />Violation 80-5a: The topsoil identified in this violation will be reapplied <br />to the area outlined in NOV 80-9a. This material will be redistributed <br />by October 10, 1980. No activity is occurring >n this area and the topsoil <br />is not exposed to any process that might dirmi.nish its c~tality or <br />quantity. If mining does occur in the western area before the reworking <br />of overburden stockpile #4 is canplete then the stockpiled topsoil <br />will be removed and placed in topsoil stockpile #1. <br />Violation 80-Sb: The topsoil continued in the sediment pond dam was <br />removed and placed in the approved topsoil stockpile. The August 29th <br />sutmittal contains all the topsoil stockpile except that topsoil <br />stockpile noted in NOV 80-Sa. This pile was not included due to its <br />temiporary nature. <br />Violation 80-SC: This violation has lx~en abated. <br />Violation 80-21: `I7ris pond has been constructed as of this date. <br />Violation BO-27-and 80-28: NIIt&E Inc. is working on these plans and <br />intends to meet the Cctober 13, 1980 deadline. <br />Carol, I am very pleased with the progress Trinidad Basin Mining is <br />making in trying to rectify the mistakes of the past operators. As <br />noted above, the changed mine plan will have complete on the ground <br />canpliance by October 10, 1980. Once Trinidad Basin Mining gets past <br />the "old problem areas" caused by the previous operators the mining <br />operator should function much more smr~othly and efficiently. I can <br />freely say that Trinidad Basin will ex~-ur~lify good mining and reclamation <br />practices for all the other mines in the area. <br />TBM and MR6E, Inc. greatly appreciate the understanding exhibited <br />by both the Division and yourself as TBM works towards completing <br />on the ground comipliance with the regulations. 4rTe are looking <br />forward to maintaining this working relationship with the Division <br />
