The operator stated that detoxified <br /> sample tailings were disposed of in the small ephemeral drainage <br /> below the site. There is no approved provision for this activity <br /> in their existing mine permit. <br /> 2) A waste rock and/or overburden stockpile is on the pilot plant <br /> site. The Division believes these piles are in excess of the <br /> temporary "small stockpiles" originally permitted. The original <br /> permit stated that pits would be backfilled, apparently by applying <br /> either a haul backfilling method or by contemporaneously <br /> backfilling. This apparently has not occurred in accordance with <br /> the approved mine plan. <br /> 3) Topsoil stockpiles were not graded 3H: 1V, seeded and stabilized. <br /> This is not in accordance with the approved mining and reclamation <br /> plan. <br /> 4) The operator has constructed four ponds, the permit allowed for <br /> only three ponds to be constructed. In addition the site drainage <br /> control is not constructed as planned and may not be adequate.
