This study was completed by Hydro-Geo Consultants, Inc. and their <br />conclusions are presented in the response to question 50. <br />83. As stated previously, the plans to relocate some reaches of Sylvester Gulch have been <br />eliminated. A study has been completed which indicates that Sylvester Gulch is a stream <br />with a biological community as defined by Rule 4.05.18(3). Sections of the relocated road <br />will be within 100 feet of Sylvester Gulch. In addition, crossings of Sylvester Gulch are <br />proposed. MCC requests the CDMG make a finding that this operation will not impact the <br />stream. The original stream channel will not be disturbed, water quality and quantity will <br />not be adversely affected due to slope stabilization methods (BMPs, revegetation and MSE <br />walls), and the reclamation plan provides for the reestablishment of appropriate riparian <br />vegetation. <br />84. The only pond included in the surface water monitoring program listed in Table 5 is MB-2R <br />since it receives flow from the refuse pile. SG-1 will not be included in the table because the <br />water monitoring requirements are specified in MCC's NPDES permit in Exhibit 7. <br />Maas and Plans (2.101 <br />85.
